About 2 months ago, I was involved in an auto accident.   Long story short, I was "waved out" into traffic by someone stopped at a light.  Well, I got hit in the turn lane.  I recieved a ticket for failure to yield.  Anyways, it totaled my brand new 2004 VW GTI.  The girl (17) who hit me was driving a 1994 Dodge Spirit with 178,414 miles on it.  Long story short, she is now suing me for almost $5,000.00 to repair her car.  According to MI no-fault law, I am responsible for the damage to her car.  The accident really isn't my fault because I was waved out by another car telling me it was clear when it was not, but legally it is my fault because I didn't yield to oncoming traffic.  I'm going to court to fight the ticket tomorrow. Anyways, this stupid lady honestly thinks that I am going to give her $5K for a car that has a blue book value in "excellent" condition which it is NOT (all rusted and beat up) of $1200.00    How stupid can people be.  Her car isn't worth $1K.  Does she honestly think I am going to give her $5K for a car that barely runs because some body shop estimated damages at $5K.  I'd consider giving her bluebook, but $5K, common.  Why the hell are people so sue happy?  I'm willing to take responsibility, but common.  Hell, my insurance company only has to give her $500.00 legally.  She only had PLPD isurance on her car.

Mi "no fault" means that your OWN insurance covers damages to YOUR car...so her insurance should be covering her, unless she is suing you because she was uninsured?

If she was uninsured, then she is going to jail.  It's illegal to not have insurance in MI.

I'd try and be happy that she's not trying to sue you for $1,000,000 for pain & suffering...

WRONG, it is your fault.  This is why I don't "wave" cars out anymore.   I only let them out if they turn in front of me going in the same direction I am travelling.

She really can't.  Not only was she not hurt, but also declined to have the ambulance personell on scence "look at her" just in case.  This is written on the police report, and she also signed a waiver saying she was fine for the ambulance people.  Then, there were 5 witness' that saw everything.  They are coming to my court date tomorrow on their own will to testify infront of the judge that I was waved into traffic. The guy that waved me is one of them.  Furthermore, if she even thinks of filing that kind of suit, I will counter suit, and bring in the cops for investigation as to why she is trying to commit insurance fraud.  If you think that she can come "later" and say my neck hurts or some B.S., I'm sure she'll have to go to see a doctor first, and if she has health insurance and they pay for the visits, I'm sure her insurance company wants to hear about the false claim.  She doesn't wanna play with me.  I'm a rotten bastard when people mess with me.  I'll ruin her 17 year old life.  She doesn't know the people I know, nor have the common sense to play this game.  I can gaurantee that one. Hell, she told the cops herself that her car barely runs.  I'm sure that will be intersting in court when I put that cop on the stand to testify that.  I've learned to shut my mouth and listen to others, she is gonna learn that the hard way.  She ran her mouth too much at the scene and made to many mistakes to try this.  Too many people saw it and heard it.  ;)

I don't disagree with that. Morally, it wasn't an accident that was my fault other than I listened when somone told me it was clear. The cop called it a "good samaritin accident"  and told me to "fight the ticket he is going to write me because he's not coming to court, if I know what he means."  We'll see if he shows tomorrow.  Legally, it's my fault.  I'm not saying that.  I'd be willing to pay her insurance deductable, or the actual blue book of the car.  I'll take responsibility and say it's my fault, not a problem.  But, I'm sure as hell not giving her $5K for a car that isn't worth $1K.  That's out of the question.

In MI, if a cop doesn't show up to court when you fight a ticket, the case is dismissed.  Does that mean my "fault" in the accident is dismissed too?

amen.. just cause they waive you out.. its YOU driving not the person waiving you out. You are responsible, period. Friend of mine had the same thing happen to him. "they waived me out" is no excuse. I as well never tell someone the coast is clear. I leave room and let them decide.

Right, I accept that. But what she wants is crazy.  She's crazy in having an attorney sending a letter demanding $5,000.00 or face legal action.  Hell, I already left him a voice mail (the attorney) and told him to schedule a court date.

Dude.  Don't get so bent out of shape over it.  This IS your fault.  I understand the dynamics of the accident, but it ends up being your fault.  It's like turning left in front of a vehicle approaching you who has his left signal on.  You're thinking he/she is going to turn left, so you turn in front of them.  However, you don't realize that they've been driving with their left signal on for the last 20 miles...  Your fault...

Go to court with evidence of the cars value and insurance.  Take that approach.

DO NOT try to place blame or deny fault, or you'll dig a hole for yourself...
