okay so basically me and bunch of guys were out riding on the street. I switched bikes with this guy who I have rode with like 2 or 3 previous times and only known him for about 2 weeks or so. I have a 2007 r6 and he has a 2006 gsxr600. I wanted to ride his because Ive never ridden a new model gsxr. so we were in an industrial park and out of no where came some gravel. I crashed. it was a bad concusion so I dont really remember it but I crashed and were I went down it was all gravely. I slid like 300 plus feet. and his bike slid, hit a curb, got airborn and then proceeded to do the nastiest series of flips. the thing is totaled. frame, swing arm, subframe, gas tank all in seperate pieces. so now for my question
I went to my insurance and they said they only cover me on my own bike, that his insurance has to cover him or any one else on his bike. He only has liability.  What do I do!?!?!??!?!? I dont have anywhere close to the amount of money to replace his bike. Im making payments on mine so selling it woudl only pay off the bike. the only option I see is paying for him to get full coverage and pay for his deductable and then claim it. but by the time I do that the insurance company will see my wounds heeling and the hospital bill date if they wanted to. Do any one have any ideas?!?!? any help would be greatly appreciated!! thank you!

Read your policy, they might be trying to get out of a legitimate claim.

Next, suck it up and pay for the bike, if you are not covered. Why? Because defrauding insurance companies can get you in deeper doo-doo than you are already in.

To the contrary, I was always told that it's the individual item that's insured not the person buying the policy, that's the reason you have to buy a policy for each item. This is the reason that someone who doesn't even own a vehicle or have auto insurance for themself, but has a legal drivers license, can drive your fully insured vehicle and get in a wreck and be covered (unless you have some type of exclusionary situation on your policy which doesn't cover anyone other than specified people in a specific policy, or in my case it was the opposite with my brothers ex-Girlfreind who was actually listed on our insurance cards for a while as not being covered by anything our insurance company covers because she had a horrendous driving record).

As far you being covered when you drive other vehicles because you have an auto insurance policy on your own personal vehicle, I have heard this is purely a myth or extremely rare at best. Some Insurance companies will cover you in a rented vehicle if you have an existing policy on another vehicle with them, and some insurance companies will cover a trailer attached to an insured vehicle without it having to have it's own policy, but I don't personally know of any Automobile Insurance company that will cover any vehicle you drive that doesn't have a policy with them.

And as for where I got this info, it was from a retired insurance agent.

hmm all interesting points. yea I dont want to mess with any insurance fraud, thats trouble and they werent born yesterday. and thank you alexa!!! its just i only have like 600 bucks in my bank account so i duno were I would come up with the money to pay off his bike. thats why Im not racing and why i am financing my bike!!! So Im guna talk to a lawyer tues and hopefully find some way to get some help from insurance, cus I just dont have the money. Like I feel horrible I crashed this kids bike. but from what I understand legally I dont have any obligation to do anything. according to my insurance company, his insurance is responsible for his bike and any hospital bills of any one riding it, and my insurance is responsible for my bike and any one riding it.  so technically i could go after him to get my hospital bills paid if i wanted to. I have like 6 grand in hospital bills. I dont want to screw him over at all, Im just kind of lost. now Im just rambling hah what a mess!!!!!!!!!!!! Thank you guys for the advice though!!!!!

Chalk this up to a lesson learned.  It may sound cruel, but that's why I don't let anyone ride my bike and I don't like to rides others bikes. Too much crap can happen. Hell! I don't even ride my Wife's bike!
I hope you heal up, and this mess is worked out for all parties involved.

Before you incur legal fees, did you pursue this with a knowledgeable person at your insurance company or accept the answer that was given to you by someone answering the phone?  Make sure you talk to your agent, who represents you and might be able to intercede with the company, and make sure you have a thorough understanding of their response.
   
You may already know that there are different types of coverage.  In general, Collision wouldn't apply since it only covers damage to your bike.  Comprehensive covers things like theft and fire.  Liability covers damage you do to other's body and property.
 
His liability will only cover bodily or property damage that he does to others.  I would expect that your liability insurance, not his, would cover damage you do to other's property.

I hope you can get this worked out...

Jim, amazing how life can change so fast!  And seem to go right down the toilet, but if ya don't mind me sounding a bit corny, this can also be a tough but good chance for you to make a friend for life and restore your good name...(if of course you had a good name before all this.) I have a buddy who let a mutual friend ride his brand new bike and he absolutely destroyed it.  It was tough, but they got together and worked out a plan for payments, required some tightening of the financial belt, but he paid off the destroyed bike in a relatively short time.  Even if the other kid does report it to his insurance company, make sure you still give him something to offset the increase in his rate.  I hope you have health insurance, but if you don't, the hospital will work out a payment plan with you as well, I should know, one day at Halifax medical center last March from my bike wreck cost me somewhere in the ballpark of $12,000.00 :err:.  My HMO covered a lot, but I am still paying stuff off, they were happy to work out the details with me.
     I hope it all works well for ya, and it will take effort on your part to make things right, but this will come to pass, and hopefully you and this kid will be good friends, and he will get to see that when a roadracer makes a mistake, we do what it takes to make things right.  Every one of us has done something like this at some point, and I am already encouraged, cause ya took the time to ask for help, that's a good sign.

Yea definatly I feel horrible  and want to replace a bike for this kid for sure. cus I just think if this happen to me how I woudl feel and what I would want to happen. so im definalty guan do my best to figure something out.  And yea I have insurance. from what I understand out of the insurance is I pay my deductable and then 20 percent of the cost.

Sue your buddy for providing you with a faulty bike.  Afterall, it was his bike which you crashed on and you got hurt right?  Then settle out of court for whatever his insurance offers, split the diff and both get new bikes!
