I bet if it was a pedestrian he rolled over things would be different.  The guy blew his horn before crunching this guy...

I think they should charge the driver of the dump truck with attempted murder or attempted homicide with a use of a motor vehicle.

Personally I think the DA is waiting to charge the driver of the dump truck based on the results of an investigation.

I am sure he will have some excuse like his foot slipped off the brake and hit the gas by mistake and he will get off with 30 days of house arrest or some stupid thing like that...  ::)  :-/

Based on that article, sounds like murder 2 (willfull act to kill and individual but no premeditation) or manslaughter (direct action that led to the death of another.  No premeditation) to me.

Felonious assualt with intent to do great bodily harm less than murder.

Wreckless Endagerment

Since the guy lived, they can't do murder 2.  Maybe attempted murder, but if they get him with Felonious assualt with intent, he'd do more time than attempt murder.

Also, use of a vehicle in commision of a felony.

PS - Chuck - Technically, when a motorcyclist is seperated from a motorcycle, the law can look upon the rider as a pedestrian. I've only seen AV rated attorneys pull off double charges, though.

It'd be awfully tough to prove the driver of the truck had any "intent to harm".

He could easily beat that (but still show himself to be a butt-hole) by saying "I just wanted to scare him a little.  Just nudge his bike because he was just sitting there and I was in a big hurry."

That's why I'd say manslaughter.  Which I believe is a greater crime than the feloneous assault.

Murder, attempted murder...

Same thing...just recognized the success of the perpetrator.  

You don't get off for being bad at completing something;  it is the act that you are sentenced for.

Living in the mountains~ I've seen riders come from all over taking those curves at 100+ mph...many wrecks and deaths ~

My own dr is in a wheel chair from losing control on a mtn road~

I guess it's all about the thrill~ and we all know what the chances are when you take chances

True.....

... but this poor guy was simply at a stop light and the guy in the dumptruck ran over him.  It makes no difference whether he was walking, riding a bike, riding a motorcycle, or diving a car, it shouldn't have happened.

This guy did nothing to put himself at an increased risk of being injured.

Uh... maybe I've missed something, but how do your comments relate to the linked newspaper article above??
